This course provides a high-level comparative analysis of the constitutional frameworks and jurisprudential traditions of the world’s two largest economies. By focusing on the fundamental rights perspective, students will examine how “rights” are conceptualized, codified, and adjudicated within two distinct political and legal ontologies: the American liberal-democratic model and the Chinese socialist rule of law with Chinese characteristics.

The curriculum moves beyond a surface-level comparison of legal texts to explore the underlying philosophical tensions between individualism and collectivism, and the prioritization of civil-political rights versus socio-economic development. Key areas of inquiry include:

  • Philosophical Foundations: A comparative study of Enlightenment constitutionalism (Locke, Madison) versus Marxist-Leninist legal theory and the contemporary “Xi Jinping Thought on the Rule of Law.”
  • The Architecture of Rights: Analysis of the U.S. Bill of Rights and the 14th Amendment in contrast to Chapter II of the PRC Constitution, focusing on the evolution of due process, equal protection, and the “right to development.”
  • Judicial Review and Interpretation: Investigating the role of the U.S. Supreme Court in “finding” rights versus the NPC Standing Committee’s power of constitutional interpretation and the shift toward “Substantive Constitutionality Review” in China.
  • Contemporary Challenges: Case studies on digital privacy, national security exceptions, and the intersection of state sovereignty with international human rights standards.

Forrest Hansen is an accomplished attorney who represents multinational corporations in complex cross-border regulatory investigations and litigation, with expertise spanning finance, technology, antitrust, FCPA, compliance, and fraud. Drawing on his background as former in-house counsel for a global financial institution, he advises senior executives on legal risk and litigation strategy before federal and state courts, as well as major regulatory bodies including the DOJ, SEC, FTC, and CFTC, with significant experience in matters involving Europe, South America, and Asia. Beyond his legal practice, he lectures in comparative constitutional law at Université Paris Cité, frequently speaks on corporate investigations and attorney well-being, and has held leadership roles at the J. Reuben Clark Law Society and Freedoms Foundation at Valley Forge. He holds a cum laude law degree from American University’s Washington College of Law and is fluent in French and Spanish.

Chief lawyer at CLA Advogados working in the environmental and regulatory area; more than 20 years of legal experience; visiting professor at the Lanzhou University School of Law (Lanzhou, Gansu, China), post-doctorate from the São Paulo Law School (FGV), doctorate in political science from the University of São Paulo (USP), master’s in international law from (USP), Master of Laws from Brigham Young University in the USA, Visiting Scholar at the Foundation for International Law & Affairs in Washington DC; leader of the advanced studies in international law and politics at Washington & Lincoln University.
